Tax Authority clarifies VAT rate applicable to gluten-free foods.

Item 1.12 of List I annexed to the VAT Code, which provides for the application of the reduced VAT rate of 6% to dietary products intended for enteral nutrition and gluten-free products for celiac patients, is not, in any case, applicable to foods that in their natural state, composition or original formulation are gluten-free, and contamination (including technically unavoidable contamination) is unlikely.

The aforementioned rate is also not applicable to foods that in their natural state, composition or original formulation have a gluten content of less than 20mg/kg.

The ruling of the Évora Court of Appeal of March 13, 2025, establishes that the liability of each guarantor is independent of that of the others, postulating that the creditor is not prevented from demanding from any of them the remaining debt not satisfied under an agreement signed with one of them.

Tax Authority - Payment of interest by the Tax Authority

The Tax Authority (AT) must pay the taxpayer default interest at a rate equivalent to twice the default interest rate defined in the general law for debts to the State and other public entities in all situations of non-compliance with the deadline for voluntary execution of a final and unappealable decision, and not only in cases of administrative appeal or judicial challenge.
