Creditor's rights with respect to each of the guarantors.
The ruling of the Évora Court of Appeal of March 13, 2025, establishes that the liability of each guarantor is independent of that of the others, postulating that the creditor is not prevented from demanding from any of them the remaining debt not satisfied under an agreement signed with one of them.
The creditor is free to enter into a payment agreement restricted to one of the guarantors of the promissory note, settling with her on whatever terms he sees fit, and this act does not mean that he has waived his right to receive the remainder of his credit from the other guarantors.
